Welcome to Wemus™, operated by Wemus Ventures Private Limited (the “Company” or “Wemus”).

By accessing or using Wemus' Services, you agree to be bound by this Terms of Use Agreement (the “Terms” or “Agreement”), including our Privacy Policy, Cookie Policy, Safety Tips, Community Guidelines, and Photo Guidelines, so it is important that you read this Agreement and these policies and procedures carefully before you create an account.

Throughout this Agreement, the terms “us,” “we,” “Company,” and/or “Wemus” refer to Wemus Ventures Private Limited, the entity responsible for the Wemus platform. Together, you and Wemus may be referred to as the “Parties” or separately as “Party”.

As used in this Agreement, the terms "Wemus," "us," "we," the "Company," and "our" shall refer to Wemus Ventures Private Limited, the legal entity operating Wemus. Together, you and Wemus may be referred to as the “Parties” or separately as “Party”.

By accessing or using the Wemus application, website (www.wemus.app), or any other platforms or services offered by Wemus (collectively, the "Service"), you agree to, and are bound by this Agreement. This Agreement applies to anyone who accesses or uses our Services, regardless of registration or subscription status.

Your access and use of our Services are also subject to the following:

Terms disclosed and agreed to by you if you purchase or accept additional features, products, or services we offer on the Service, such as terms governing features, billing, free trials, discounts, and promotions.

These documents are incorporated into this Agreement by reference. If you do not wish to be bound by this Agreement, do not access or use our Services.

Acceptance of Terms
By accessing or using our Services, you accept this Agreement and agree to the terms, conditions, and notices contained or referenced herein. Your continued access or use of our Services constitutes your ongoing consent to any changes made to this Agreement.

Subject to applicable law, we reserve the right to modify, amend, or change the Terms at any time. Notice of material changes will be posted on our website with an updated effective date. While we may notify you of changes via email or other means, you are responsible for regularly checking our website for any updates. Your continued access or use of our Services after any changes constitute your acceptance of the updated Terms.

2. Account Eligibility; Your Responsibilities

Before you create an account on Wemus, ensure that you meet the eligibility criteria outlined in this section. By using our Services, you represent and warrant that you meet these requirements and agree to abide by the terms and conditions set forth herein.

You are not authorized to create an account or use the Services unless all of the following conditions are true:

Age and Legal Capacity: You are an individual who is at least 18 years old, (not a corporate entity, partnership, or any other business organization) and legally qualified to enter into a binding contract with Wemus.

Location Restrictions: You are not located in a country subject to any sanctions, embargoes, or restrictions imposed by the Indian government or any relevant international regulatory bodies.

Legal Compliance: You are not prohibited by law from using our Services, and you agree to comply with all applicable laws and regulations, including but not limited to those related to privacy, intellectual property, and online conduct.

Criminal Background: You have not been convicted of any felony, sex crime, violence-related offense, or any offense that poses a threat to the safety or well-being of others, unless you have been granted clemency and Wemus determines that you do not pose a risk to other users.

Sex Offender Registry: You are not required to register as a sex offender with any government authority.

Single Account: You agree to maintain only one active account on Wemus and will not create multiple accounts.

Previous Account Status: You have not previously been removed from Wemus or any affiliated services, unless you have obtained express written permission from Wemus to create a new account.

If you cease to meet these requirements, your authorization to access our Services is automatically revoked, and you must delete your account.​
Your Responsibilities:

By accessing or using our Services, you agree to:

Comply with these Terms and check for updates periodically.

Comply with all applicable laws and regulations in your country or jurisdiction.

Use the latest version of the Website and/or App.

Review and adhere to the Safety Tips and Community Guidelines.

Take reasonable measures to protect the security of your login information.

You agree not to:

Misrepresent your identity, age, or affiliations with any person or entity.

Use the Services in a way that damages them or prevents their use by other users.

Interfere with, disrupt, or negatively affect the platform, servers, or networks of our Services.

Use our Services for any harmful, illegal, or nefarious purpose, including but not limited to using Virtual Items for money laundering or other financial crimes.

Harass, bully, stalk, intimidate, assault, defame, harm, or otherwise abuse or cause psychological harm to other users.

Post or share Prohibited Content as outlined in our community guidelines.

Solicit passwords or personal identifying information from other users for commercial or unlawful purposes without their permission.

Solicit money or other items of value from other users, whether as a gift, loan, or form of compensation.
-
Use another user's account without permission.

Engage in fraud, pyramid schemes, or similar practices while using our Services.
-
Use our Services for political campaign financing or to influence any election, other than sharing personal political opinions.

Violate the terms of the license granted to you by Wemus, as outlined in Section 6 below.

Disclose private or proprietary information without the right to do so.

Copy, modify, transmit, distribute, or create derivative works from any Member Content, Our Content, or copyrighted material without Wemus's prior written consent.

Express or imply that any statements you make are endorsed by Wemus.

Use any robot, crawler, or automatic device to access or retrieve information from our Services without authorization.

Upload viruses or other malicious code, or compromise the security of our Services.
-
Forge headers or manipulate identifiers to disguise the origin of information transmitted through our Services.
-
"Frame" or "mirror" any part of our Services without Wemus's prior written authorization.

Use or publish the Wemus application programming interface without written consent.
-
Probe, scan, or test the vulnerability of our Services or any system or network.
-
Encourage, promote, or engage in any activity that violates these Terms.

Create a new account after Wemus suspends or terminates your account without express permission.
-
Submit false, misleading, or unfounded reports about a member’s behavior or content, or abuse any reporting or appeals system provided by Wemus.

The license granted to you under these Terms and any authorization to access the Services is automatically revoked if you engage in any of the above activities.

We have strict guidelines regarding the content uploaded or shared on our platform, including:

Content that may reasonably offend, harass, or cause psychological distress to others.

Material that is explicit, violent, or contains nudity.

Any form of discrimination, threats, or promotion of hatred.

Encouragement or facilitation of illegal activities, including terrorism or inciting racial hatred.

Material promoting self-harm, eating disorders, dangerous challenges, or violent extremism.

Defamatory or untrue content.

Commercial activities, such as sales or promotions, unless permitted by Wemus.

Spam or malicious content designed to disrupt or damage our platform or users.

Infringement upon intellectual property or privacy rights.

Content not authored by the user, unless authorized by Wemus.

Unauthorized use of another person's likeness or depiction of minors without consent.

Content inconsistent with the intended use of our Services.

Material that may harm the reputation of Wemus or its affiliates.

Sharing or uploading such content, known as "Prohibited Content," may lead to immediate suspension or termination of your account.

3. Content

At Wemus, we emphasize understanding your rights and responsibilities concerning the content on our platform. This includes content you provide or post, and we strictly prohibit inappropriate content.

3a. Your Content
​
You hold responsibility for Your Content. Avoid sharing anything that violates this Agreement or could expose you or us to legal liability.
​
You are accountable for Your Content and agree to indemnify, defend, release, and hold us harmless from any related claims.
​
Represent that the information provided, including through third-party sources like Facebook, is accurate, and commit to updating it as necessary.
​
Ensure that your profile content aligns with our intended use. Do not upload Prohibited Content and adhere to the Community Guidelines. Avoid displaying personal contact or banking information.
​
Acknowledge that Your Content may be viewed and shared by other users worldwide. By uploading Your Content, you grant us a license to use it as outlined in Section 7.
​
We may offer tools to enhance Your Content and Member Content. Exercise caution in choosing and sharing Your Content, as you are responsible for its accuracy and consequences.
​
Understand that we may monitor or review Your Content and have the right to remove or limit it at our discretion.
​
3b. Member Content
​
Access Member Content with the understanding that it belongs to the respective user. Do not copy or misuse Member Content, and verify its accuracy independently.
​
Users are accountable for their Member Content and any decisions made based on it. You may use Member Content only as consistent with our platform's purpose and refrain from unauthorized copying or commercial use.

3c. Our Content
​
Wemus holds ownership or licensing rights to all other content on our platform, protected by copyright and trademark laws.
​
We grant you limited access to Our Content as outlined in Section 6, while retaining all other rights.
​

4. Addressing Inappropriate Conduct and Content; Reporting
​
At Wemus, we prioritize the safety and security of our users and maintain strict standards against inappropriate behavior and content.

In line with our Privacy Policy, we may share data with trusted affiliates to uphold the safety and security of our users. Should a user violate our Terms of Service, we reserve the right to take necessary actions, including but not limited to banning the user from Wemus and our associated services.

You acknowledge and consent to our discretion in withholding account information if such disclosure may compromise the safety or privacy of our user community.

5. Privacy assurance

Your privacy matters to us greatly. We have a dedicated policy regarding it, which we highly recommend you review.

To understand how Wemus and its affiliated platforms gather, utilize, and disclose your personal information, please refer to our Privacy Policy. By utilizing our Services, you consent to the utilization of your personal data in accordance with our Privacy Policy.

6. Rights granted by Wemus
Wemus provides you with the privilege to access and enjoy our Services, contingent upon adherence to these Terms.

For as long as you adhere to these Terms, Wemus grants you a personal, global, royalty-free, non-transferable, non-exclusive, revocable, and non-sub licensable license to utilize and access our Services for purposes intended by Wemus and permitted by these Terms and relevant laws. This license and any authorization to access the Service are automatically rescinded if you fail to comply with these Terms.

7. Your content permissions
You maintain ownership of all the content you provide to Wemus, while also granting us the privilege to utilize Your Content as outlined in this Agreement.

Upon creating an account, you grant Wemus a worldwide, perpetual, transferable, sublicensable, royalty-free right and license to host, store, use, copy, display, reproduce, adapt, edit, publish, translate, modify, reformat, incorporate into other works, advertise, distribute, and otherwise make available Your Content to the general public. This includes any information you authorize us to access from Facebook or other third-party sources (if applicable), in whole or in part, and in any format or medium currently known or developed in the future. The license granted to Wemus for Your Content is non-exclusive, except for derivative works created through the use of our Services, for which it is exclusive. For instance, Wemus would have an exclusive license to screenshots of our Services containing Your Content.

Furthermore, to prevent the use of Your Content outside of our Services, you authorize Wemus to act on your behalf regarding any infringing uses of Your Content taken from our Services by other users or third parties. This includes the authority, though not the obligation, to send notices pursuant to applicable laws on your behalf if Your Content is taken and used by third parties outside of our Services. Wemus is not obligated to take action concerning the use of Your Content by other users or third parties. Our license to Your Content is subject to your rights under applicable law, such as laws regarding personal data protection, to the extent the content contains personal information as defined by those laws.

In exchange for allowing you to use our Services, you consent to Wemus, our affiliates, and third-party partners placing advertisements on our Services. By submitting suggestions or feedback to Wemus regarding our Services, you agree that Wemus may use and share such feedback for any purpose without compensating you.

You acknowledge and agree that Wemus may access, preserve, and disclose your account information, including Your Content, if required by law or upon a good faith belief that such access, preservation, or disclosure is reasonably necessary to: (i) comply with legal processes; (ii) enforce these Terms; (iii) respond to claims that any content violates the rights of third parties; (iv) address your requests for customer service; (v) safeguard the rights, property, or personal safety of Wemus or any other person; or (vi) investigate, prevent, or take other action regarding illegal activity, suspected fraud, or other wrongdoing.

8. Account termination
​
Should you choose to discontinue using our Services or if we deactivate your account for any reason, here's what you need to know.

You have the option to delete your account at any time by accessing the Wemus app, navigating to "Settings," selecting "Delete Account," and following the provided instructions to complete the deletion process.

Wemus reserves the right to investigate and, if deemed appropriate, suspend or terminate your account if we believe you have violated these Terms or engaged in behavior that we consider inappropriate or unlawful, whether on or off our Services. We retain the right to take necessary actions to enforce the Terms, at our discretion and without prior notice, including restricting your access to the Services.

In the event of your account's termination, either voluntarily or by Wemus, these Terms will cease to apply, and your account information will be handled in accordance with our Privacy Policy.

9. Background Checks and User Conduct
​
At Wemus, we do not conduct criminal background or identity verification checks on our users. While we aim to foster a respectful user environment, we cannot control the behavior of individuals on or off our platform. We urge you to exercise caution and refer to our Safety Tips for guidance.

You acknowledge and understand that Wemus does not perform criminal background or identity verification checks on its users, nor does it inquire into their backgrounds. Wemus does not make any representations or warranties regarding the conduct, identity, health, intentions, or legitimacy of its users. However, Wemus reserves the right to conduct criminal background checks or other screenings, such as searches of sex offender registries, using available public records, with your consent.

You are solely responsible for your interactions with other users, and Wemus cannot guarantee your safety. We strongly advise you to follow our Safety Tips and exercise caution when communicating with or meeting new people. Please use your best judgment and take appropriate safety precautions at all times.

While Wemus endeavors to promote a respectful user experience, we are not liable for the actions of users, whether on or off our platform. You agree to proceed with caution in all interactions with other users, especially if you choose to communicate outside our platform or meet in person.

10. Disclaimer
​
Wemus' Services are provided on an "as is" and "as available" basis, and while we strive for excellence, we cannot guarantee the accuracy, completeness, or reliability of our Services or Member Content.

WEMUS PROVIDES NO WARRANTIES, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, REGARDING OUR SERVICES, INCLUDING ANY IMPLIED WARRANTIES OF SATISFACTORY QUALITY, MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT GUARANTEE THAT OUR SERVICES WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE, NOR DO WE WARRANT THAT ANY DEFECTS OR ERRORS WILL BE CORRECTED. ADDITIONALLY, WE CANNOT GUARANTEE THE ACCURACY, COMPLETENESS, OR SUITABILITY OF ANY CONTENT OR INFORMATION OBTAINED THROUGH OUR SERVICES.

WEMUS ASSUMES NO RESPONSIBILITY FOR ANY CONTENT POSTED, SENT, RECEIVED, OR ACTED UPON THROUGH OUR SERVICES BY YOU, OTHER USERS, OR THIRD PARTIES. WE ALSO DO NOT ASSUME RESPONSIBILITY FOR THE IDENTITY, INTENTIONS, LEGITIMACY, OR TRUTHFULNESS OF ANY USERS YOU MAY INTERACT WITH ON WEMUS. ANY MATERIAL DOWNLOADED OR OBTAINED THROUGH THE USE OF OUR SERVICES IS DONE AT YOUR OWN DISCRETION AND RISK.

WEMUS IS NOT LIABLE FOR ANY DAMAGE TO YOUR COMPUTER HARDWARE, SOFTWARE, OR OTHER EQUIPMENT OR TECHNOLOGY ARISING FROM THE USE OF OUR SERVICES, INCLUDING BUT NOT LIMITED TO DAMAGE FROM SECURITY BREACHES, VIRUSES, BUGS, TAMPERING, HACKING, FRAUD, ERRORS, INTERRUPTIONS, DEFECTS, DELAYS, OR OTHER TECHNICAL DISRUPTIONS.

IT'S IMPORTANT TO UNDERSTAND THAT YOUR USE OF WEMUS IS AT YOUR OWN RISK, AND WE RECOMMEND USING CAUTION AND COMMON SENSE WHEN INTERACTING WITH OTHERS ON OUR PLATFORM.

11. Copyright infringement policy

We take copyright infringement seriously and strive to address it promptly and effectively. If you believe that any content on our platform infringes your copyright, please follow the procedures outlined below.

A physical or electronic signature of a person authorized to act on behalf of the copyright owner.

Identification of the copyrighted work claimed to have been infringed, or a representative list of such works if multiple works are involved.

Identification of the infringing material and its location on our platform, along with sufficient information to locate the material.

Contact information, including your full name, address, telephone number, and email address.

A statement that you have a good faith belief that the use of the material is not authorized by the copyright owner, its agent, or the law.

A statement, made under penalty of perjury, that the information provided is accurate and that you are authorized to act on behalf of the copyright owner.

Upon receiving a valid notification, we will promptly investigate the alleged infringement and take appropriate action, which may include removing or disabling access to the infringing material. We may also terminate the accounts of repeat infringers in accordance with our policies.

12. Advertisements and third-party content
​
While using Wemus, you might come across advertisements and promotions from third-party sources. Wemus does not endorse or take responsibility for any interactions you have with these products or services.

Our platform may display ads, promotions, and links to external websites or resources provided by third parties. Additionally, there might be opportunities to view ads in exchange for Virtual Items, although we cannot guarantee their availability. Wemus may also make non-commercial mentions of third parties in its content.

It's important to note that Wemus does not control the content or availability of external websites or resources, and we do not endorse any products or services offered by third parties. Any interactions you have with third parties through our platform are governed by their respective terms, for which Wemus holds no responsibility.

13. Limitation of liability
​
Wemus, its subsidiaries, affiliates, employees, agents, licensors, and service providers ("Related Parties") shall not be liable for any direct, indirect, incidental, consequential, exemplary, special, or punitive damages, including but not limited to, loss of profits, data, or goodwill, arising from:

Your use of the Wemus app or its services.

Any content or information obtained through the Wemus app.

Any unauthorized access to or alteration of your transmissions or data.

Any conduct or content of third parties on or through the Wemus app.

Any errors or omissions in the Wemus app's operation or content.

To the Fullest Extent Permitted by Applicable Law, Wemus, its affiliates, employees, agents, licensors, or service providers shall not be liable for any damages whatsoever, whether direct, indirect, general, special, compensatory, consequential, and/or incidental, arising out of or relating to:

The conduct of you or anyone else in connection with the use of the service.

Bodily injury, emotional distress, loss of use, loss of data, loss caused by a computer or electronic virus, loss of income or profit, loss of or damage to property, wasted management or office time, breach of contract, or claims of third parties.

Loss resulting from communications or meetings with other users of the service or persons you meet through this service.

Wemus' maximum liability arising out of or in connection with the Wemus app or your use of its content, regardless of the cause of action (whether in contract, tort, breach of warranty, or otherwise), shall not exceed the greater of (A) the amount paid by you to Wemus for the services or (B) the minimum liability permitted by applicable law.
​
The damages limitation provisions set forth in this section shall apply even if your remedies under this agreement fail with respect to their essential purpose. Wemus expressly disclaims any liability whatsoever for any damage, suits, claims, and/or controversies that arise or relate in any way to its website or app.

Wemus will provide its service to you with reasonable skill and care but does not make any warranties or representations (neither express nor implied) with respect to the website, app, or the associated services.
​
These terms shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law principles. Any dispute arising from or relating to these terms or your use of the Wemus app shall be subject to the exclusive jurisdiction of the courts in Mumbai, India.
​

14. Indemnification
​
You agree to defend, indemnify, and hold Wemus, its subsidiaries, affiliates, officers, directors, shareholders, employees, agents, and partners harmless from and against any and all claims, damages, losses, costs, investigations, liabilities, judgments, fines, penalties, settlements, interest, and expenses (including attorneys’ fees) that arise from or are related to:

(i) Any data posted or otherwise provided by you on the Wemus app.
(ii) Your use of materials on the Wemus app.
(iii) Your activities in connection with the Wemus app, including communications and meetings with other members.
(iv) Your breach or alleged breach of these Terms of Service or any additional terms.
(v) Your violation or alleged violation of any laws, rules, regulations, or orders of any governmental or quasi-governmental authorities in connection with your use of the Wemus app or your activities related to it.
(vi) Information or material transmitted through your device, even if not submitted by you, that infringes, violates, or misappropriates any rights of any person or entity.
(vii) Any misrepresentation made by you.
(viii) Wemus' use of the information that you submit to us.

You agree to cooperate fully with Wemus in the defense of any claims and losses. Wemus reserves the right to assume the exclusive defense and control of any matter subject to indemnification by you, and you agree to cooperate with Wemus' defense of these claims. You will not settle any claims and losses without Wemus' prior written consent.

15. Governing law and jurisdiction
​
These Terms shall be governed by and construed in accordance with the laws of India, excluding any principles of conflicts of laws that would require the application of the laws of another jurisdiction. The courts of Mumbai, India, shall have exclusive jurisdiction over any disputes arising out of or relating to these Terms, including any claims regarding their validity, interpretation, breach, or termination. If you are a consumer residing in a jurisdiction where mandatory consumer protection laws or regulations provide for the exclusive jurisdiction of consumer claims in courts other than those specified herein, you retain the right to assert claims in such courts, provided that the laws of India are not thereby overridden as the governing law. Nothing in these Terms shall affect the statutory rights of consumers to which they are entitled under the consumer protection laws and regulations of their country of residence.

16. Dispute resolution
Any dispute, claim, or controversy arising out of or relating to these Terms or the breach, termination, enforcement, interpretation, or validity thereof, including the determination of the scope or applicability of this agreement to arbitrate, shall be determined by arbitration in Mumbai, India, before a sole arbitrator. The arbitration shall be administered by Mediation Services, Inc. ("JAMS") in accordance with its Comprehensive Arbitration Rules and Procedures. The arbitration shall be governed by the laws of India, excluding its conflict of law provisions. Notwithstanding the arbitration clause herein, either party may bring suit in court to enjoin infringement or other misuse of intellectual property rights. The arbitration proceedings shall be conducted in English.

17. Waiver and severability
The failure of either party to enforce any right or provision of these Terms will not constitute a waiver of future enforcement of that right or provision. The waiver of any right or provision shall be effective only if in writing and signed by a duly authorized representative of the waiving party. If any provision of these Terms is held to be invalid or unenforceable by a court or arbitrator, the remaining provisions of these Terms will remain in full force and effect to the fullest extent permitted by law.

18. Force Majeure
​
Neither party shall be liable for any failure or delay in performing its obligations under these Terms to the extent that such failure or delay is caused by a Force Majeure Event. A "Force Majeure Event" means any event beyond the reasonable control of a party, including but not limited to acts of God, fire, flood, earthquake, explosion, war, terrorism, invasion, riot, strike, embargo, government regulation, or any other cause beyond the reasonable control of the party affected.

If a Force Majeure Event occurs, the affected party shall promptly notify the other party and make all reasonable efforts to mitigate the impact of the Force Majeure Event on the performance of its obligations under these Terms. The affected party's obligations under these Terms shall be suspended for the duration of the Force Majeure Event, and the time for performance of those obligations shall be extended for a period equal to the duration of the Force Majeure Event. If the Force Majeure Event continues for a period of 30 days or more, either party may terminate these Terms by providing written notice to the other party.

19. Entire agreement
These Terms, together with the Privacy Policy and any other legal notices published by us on the app, shall constitute the entire agreement between you and us concerning the app and supersede all prior or contemporaneous communications and proposals, whether electronic, oral, or written, between you and us regarding the app.

20. Communication between us
